1. Introduction

Welcome to BuzzBistro. These Terms of Service ("Terms") govern your access to and use of the BuzzBistro website, mobile applications, and services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

2. Definitions

Throughout these Terms, we may use certain terms that have specific meanings:

• "Account" means a unique account created for you to access our Service.

• "Restaurant" refers to the business entity using our Service to manage their restaurant operations.
• "User" means any individual who uses our Service, including Restaurants and their customers.

3. Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You may not use as a username the name of another person or entity that is not lawfully available for use, or a name or trademark that is subject to any rights of another person or entity without appropriate authorization.

4. Subscription and Billing

BuzzBistro offers various subscription plans for Restaurants. By selecting a subscription plan, you agree to pay the subscription fees as described at the time of purchase.

Subscription fees are billed in advance on a monthly or annual basis, depending on the billing cycle selected at the time of purchase. You authorize us to charge your designated payment method on a recurring basis until you cancel your subscription.

You may cancel your subscription at any time through your account settings or by contacting our customer support team. Upon cancellation, your subscription will remain active until the end of your current billing period, and you will not receive a refund for any unused portion of your subscription.

We reserve the right to change our subscription plans or adjust pricing for our service at any time. Any price changes will become effective at the end of the then-current billing cycle.

5. Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of BuzzBistro and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of BuzzBistro.

By uploading or sharing Content on our Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, publish, and distribute such Content in connection with providing and improving our Service.

6. Prohibited Uses

You agree not to use the Service:

• In any way that violates any applicable national or international law or regulation.
• To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter," "spam," or any other similar solicitation.

BuzzBistro utilizes artificial intelligence (AI) technology to provide various features of the Service. By using our Service, you acknowledge and agree to the following:

• The AI may generate responses based on the information you provide and its training data.
• While we strive for accuracy, the AI may sometimes provide incomplete or incorrect information.
• The AI will have access to the data you provide to our Service, including customer interactions, menu information, and operational data.
• We may use anonymized data from your interactions to improve our AI and Service.
• You are responsible for reviewing and verifying any information or content generated by the AI before using it in your business operations.

8. Limitation of Liability

In no event shall BuzzBistro, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service.
• Any conduct or content of any third party on the Service.
• Any content obtained from the Service.
• Unauthorized access, use, or alteration of your transmissions or content.
• Errors, mistakes, or inaccuracies in our Service.
• The actions or inactions of the AI assistant when interacting with your customers.

The limitations of liability set forth above shall apply to the fullest extent permitted by law in the applicable jurisdiction.

9. Indemnification

You agree to defend, indemnify, and hold harmless BuzzBistro and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from your use of and access to the Service, including any data or content transmitted or received by you, any other party's access or use of the Service with your username and password, or your violation of these Terms.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
